Terms of Service

By registering an account or using chcks.co ("the Platform", "the Service"), you ("Merchant", "you") agree to be legally bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service.

We may update these Terms from time to time. Material changes will be notified by email at least 14 days in advance. Continued use after the effective date constitutes acceptance.

chcks.co is a subscription-based, non-custodial crypto point-of-sale and payment gateway platform that allows merchants to:

• Create and manage digital menus, product catalogues, and point-of-sale terminals
• Accept native cryptocurrency payments directly to their private wallets
• Accept cross-chain payments in BTC, ETH, SOL, LTC, USDT and other assets routed via automated non-custodial exchange protocols directly into the merchant's chosen payout asset
• Accept Telegram Stars (XTR) for digital and in-app checkout
• Generate QR codes for table-side, online checkout, and payment links
• Issue cryptographically signed, verifiable receipts
• Manage orders, tables, and live kitchen displays
• Access a REST API for e-commerce and external integrations

Non-Custodial Nature: chcks.co is strictly a software technology provider. We never take custody, hold, escrow, or transmit merchant funds. All payments settle directly peer-to-peer or through third-party swap protocols directly to the merchant's designated wallet address.

3.1 Plans

Access to the Platform is provided on a flat subscription model with 0% processing fees taken by chcks.co:

3.2 Payment Method

Subscription fees are paid in USDT on the TON network, sent directly to the chcks.co platform wallet. Payments are manual — there are no automatic recurring charges. Subscriptions must be renewed before expiry to maintain uninterrupted access.

3.3 No Refunds

Due to the nature of crypto transactions (irreversible on-chain), subscription payments are non-refundable once confirmed on the blockchain. If you have a billing dispute, contact us at [email protected] within 7 days of payment.

3.4 Suspension for Non-Payment

If your subscription expires, access to the dashboard and API will be suspended. Your data will be retained for 30 days after expiry, after which it may be deleted.

chcks.co does not hold, custody, or have access to your funds at any time.

• All customer payments go directly to your configured TON wallet address.
• We never intermediate or escrow funds.
• You are solely responsible for securing your wallet private keys and seed phrases.
• We cannot reverse, cancel, recover, or refund any on-chain transaction.
• Loss of wallet access is permanent and irrecoverable — we have no means to assist.

By using the Service, you agree to:

• Provide accurate and truthful information during registration and use.
• Keep your account credentials and wallet secure.
• Comply with all applicable local, national, and international laws, including tax obligations on crypto receipts.
• Not use the Service for money laundering, sanctions evasion, or any illegal activity.
• Not resell or sublicense access to the Platform.
• Not attempt to reverse-engineer, scrape, or abuse the API.
• Accept full responsibility for all orders and transactions generated under your account.

Merchants on an active subscription may access the chcks.co REST API using a Bearer token (csr_...). API usage is subject to these Terms.

• API keys must be kept confidential — treat them as passwords.
• Rate limits apply to prevent abuse. Excessive usage may result in temporary throttling.
• We reserve the right to revoke API access for abuse or violation of these Terms.

You acknowledge and accept all risks associated with cryptocurrency payments, including:

• Price volatility — TON and USDT values may fluctuate significantly.
• Network congestion — transaction confirmation times are outside our control.
• Irreversibility — confirmed blockchain transactions cannot be reversed.
• Wallet compatibility — users must use a TON-compatible wallet (e.g. Tonkeeper).
• Regulatory risk — crypto regulations vary by jurisdiction and may change.

chcks.co is designed to comply with the EU Markets in Crypto-Assets Regulation (MiCA, EU 2023/1114):

• Non-custodial — no user funds are ever held by chcks.co.
• Wallet-based — no KYC is required from merchants or their customers.
• Transparent — all transactions are verifiable on the TON public blockchain.
• Full data portability — merchants can export all transaction history at any time.

All software, design, branding, and content on chcks.co is owned by chcks.co and protected by applicable intellectual property law. You may not copy, reproduce, or distribute any part of the Platform without written permission.

Your merchant data (products, orders, receipts) remains yours. We claim no ownership over content you create on the Platform.

We collect and process data as described in our Privacy Policy, including request logs (IP address, browser, language, page visited) for security and abuse prevention purposes. By using the Service, you consent to this processing.

The Service is provided "as is" without warranty of any kind. We do not guarantee:

• Uninterrupted or error-free operation of the Platform.
• Availability of the TON blockchain or third-party wallet apps.
• Accuracy of real-time cryptocurrency data.

To the maximum extent permitted by law, chcks.co's total liability for any claim arising from use of the Service shall not exceed the subscription fees paid by you in the three months preceding the claim. We are not liable for indirect, consequential, or incidental damages.

12.1 By you

You may close your account at any time via Settings → Privacy → Delete account. Subscription fees already paid are non-refundable.

We reserve the right to suspend or terminate your account immediately and without notice if you:

• Violate these Terms or our Privacy Policy.
• Use the Service for illegal or fraudulent activity.
• Abuse the API or infrastructure in a way that affects other users.

On termination, your data will be retained for 30 days for export purposes, then permanently deleted.

These Terms are governed by the laws of the European Union and the jurisdiction in which chcks.co is registered. Any disputes shall be resolved in the competent courts of that jurisdiction.
